BEWARE IN MICHIGAN

[Used and Abused in Michigan]

I want to make everyone in Michigan aware of a pool seller/installer you should avoid at all costs. I would not suggest you do any business at all with an individual by the name of Ken Kitchel. He holds himself out as the Regional Sales Manager for American Fiberglass Pools.

I did my homework prior to signing any contracts, and felt I had made a wise decision in trusting the above individual to install my pool. I could not have been more wrong. I am now in year 2 of what seems to be evolving into a never ending story.

Mr. Kitchel has never finished our installation, and still owes us many items for our pool. He is one broken promise after another and will not return phone calls or answer his phone unless we call from a number he does not recognize on caller ID. Beyond the items we are still owed is the lien that has been placed on my property by the fence contractor that is still waiting on final payment. I have also been forced to contract with another company to come in and correct the backfilling of the pool hole. If I do not have this corrected I have been told by several qualified parties that my pool will soon crack and be unuseable.

I am preparing to file legal action against Mr. Kitchel but have been informed by my attorney that he has no assets to attach to satisfy any judgement we would win. The manufacturer of my pool, American Fiberglass Pools, has refused to be of any assistance even though our contract was with them and every check written for the job was made payable to American Fiberglass Pools. The company is located in Texas and I would have to file suit in that state against the manufacturer. The only problems there is that the cost to file suit and obtain judgement would be greater than the amounts owed. This is a fact I am sure the owner of the company is very aware of.

Run, do not walk, away from any dealings with the above individuals. I would not wish this experience on my worst enemy!
