Hillbilly Hot Tub Posted January 8, 2009 Report Posted January 8, 2009 I just called Infinity to see when they thought they might pay the money owed since September (I have been calling, faxing ect to hear they are working on it) and was told the have filed Chapter 11 Bankruptcy and sent me paperwork to fill out for the court. If they owe you money, you need to put a claim in to the TN court. Their case number is 2:08-bk-52293. You have until March 23rd to do this. They were suppose to notify all there creditors, but I guess service techs do not count since they did not notify us. Good luck..... Quote

I wonder how the spa industry is holding up with the economy the way it is. I wonder if there will be a shake out in the industry with some companies (like Infinity) folding. Quote
Hillbilly Hot Tub Posted January 8, 2009 Author Report Posted January 8, 2009 I know we have lost 3 dealers in our area, a Hydro pool dealer, a Sundance/Nordic dealer, a Jacuzzi dealer. I think many of the lower end tub companies may go, but the higher end companies will stay, they may struggle in sales, but will hold on. It will be an interesting year and I think the market will swing to higher end tubs because people that have the excess money want quality that will last. Quote

I think people are just hunkering down and holding on to their money right now b/c they don't know what's going to happen next. I wish all spa dealers (car dealers, boat dealers, retailers, etc.) the best of luck this year. Public school systems are pretty recession proof so my job is secure (esp. since I teach special ed.) but my husband is in the construction/home remodeling business and he came home today saying, "No leads again today, not one!" Theres a Costco about 90-100 miles south of me and a couple Infinitys have shown up for some repair up by me but my bill to tub owner policy has protected me. But I may have a customer who is waiting for reimbursment. I dout they have any recourse. Quote

Sandy, you are right about the economy, what we are seeing is the "working class" customers are gone, but our customers that have second homes here in the ski areas are replacing old tubs or deciding to get a tub because it is a buyers market for them, they are getting the best deals right now, but we reley on our everyday working Joe smoes, and they are all just having a hard time....me included! As another side note Sandi...I worked with people with challenges and in the special ed in the school for 17 years before we started this buisness and I know I always have a job to go back to if needed! Roger, When Infinity first went out of business, I contacted Costco and got this guy's name and phone number. You may want to pass it along to your customer who is waiting for a reimbursement from Infinity (assuming they bought their spa from Costco): I just want to confirm that Costco.com will stand behind the original warranty on your spa regardless what happens with the Infinity Spa buyout. Please contact me if you ever have any spa issue. Sandi I gave this to them a while ago and last time I checked they had no luck with it. Things may have changed in the couple months it's been since I have talked to that particular customer. They were also talking about returning there tub to Costco but they were not sure if they could as they did not see the return policy I mentioned to them. Again, been a couple months now and I don't hear from most of my customers unless something is broke. And I have been turning down 60-80 percent of my calls anyway. They owed me for months for a few service calls also. Every time I would call/fax I would get "let me check into it and I'll call you back"... After a while I just gave up. It doesn't seem worth the headaches of the legal system just to get a few bucks. The messed up part is... even after I told them that I will not do any work for them, they would just keep faxing me service requests. And then even asked me to fax back thier sro's once so they could find someone else to do them. As far as them going under, I don't think it could of happened to a better group of people. Another thing I noticed, is these home warranty companys don't like pay either. You guys had any issues with them? Quote

When I was doing service I quickly learned about "retainers"... e.g. send me a check FIRST, then I'll go fix the spa...Actually had one company willing to comply. Quote
